Abstract
The forefathers of our nation gifted us with a democracy which by its very definition assumes a Judiciary and an independent one too. Independent Judiciary is backbone of the democratic state because it protects and preserves the concept of rule of law which is an essential part of democracy. Democracy is not functional if there is not an impartial body to review the state’s action as state cannot be the Judge in its own cause. The main objective of this Article is to clearly understand the Importance of Independence of Judiciary in a democratic setup. In this Article I analyze the various provisions of Constitution related to independence of judiciary. I have also critically analyzed the provisions of National Judicial Appointments Commission Act, 2014. In this Article it is strongly recommended that possible measures should be taken to protect the Judges against political influence for securing impartiality and independence of judiciary.
